1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Firewall Academy's security awareness training platform ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

These Terms apply to organizational customers ("Customer" or "you") who purchase training services, and to employees and authorized users ("End Users") who access training through their organization. If you are an End User, your organization's agreement with us governs your use of the Service.

2. Description of Service

Firewall Academy provides security awareness training services designed to help organizations educate their workforce on cybersecurity best practices, compliance requirements, and threat awareness. Our Service includes:

  • Online training courses and educational content
  • Quizzes and assessments to measure comprehension
  • Progress tracking and completion reporting
  • Administrative tools for managing training campaigns
  • Compliance documentation and audit reports

3. Account and Access

3.1 Customer Accounts

Customers are responsible for:

  • Providing accurate organization and billing information
  • Designating authorized administrators
  • Managing End User access and permissions
  • Ensuring End Users comply with these Terms
  • Maintaining the security of account credentials

3.2 End User Access

End Users must:

  • Access the Service only through their organization's account
  • Complete assigned training in good faith
  • Not share login credentials or access with others
  • Not attempt to circumvent training requirements or assessments

4. Fees and Payment

Fees for the Service are based on course completions as specified in your order or agreement. All fees are non-refundable except as expressly stated in writing. We reserve the right to modify pricing with 30 days' notice for future purchases.

Customers are responsible for all applicable taxes. Late payments may result in suspension of access to the Service until the account is brought current.

5. Intellectual Property

5.1 Our Content

All training content, course materials, software, trademarks, and other intellectual property in the Service are owned by Firewall Academy or our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal training purposes during the term of your subscription.

5.2 Restrictions

You may not:

  • Copy, modify, or distribute training content
  • Reverse engineer or attempt to extract source code
  • Resell, sublicense, or provide the Service to third parties
  • Remove or alter any proprietary notices
  • Use the Service for any unlawful purpose

6. Data and Privacy

Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that training completion data, assessment results, and related reports will be accessible to your designated administrators. You are responsible for ensuring your End Users are informed about the collection and use of their training data.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with reasonable advance notice)
  • Emergency maintenance or security updates
  • Circumstances beyond our reasonable control

We will use commercially reasonable efforts to minimize disruption and provide notice of planned maintenance.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

While our training is designed to improve security awareness, we do not guarantee that completing our courses will prevent security incidents. Security awareness training is one component of a comprehensive security program.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIREWALL ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO FIREWALL ACADEMY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Firewall Academy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your misuse of the Service
  • Your violation of any applicable law or regulation
  • Any claim by an End User related to their use of the Service through your account

11. Term and Termination

These Terms remain in effect while you use the Service. Either party may terminate the agreement:

  • Upon completion of purchased training services
  • For material breach, with 30 days' written notice and opportunity to cure
  • Immediately if the other party becomes insolvent or ceases operations

Upon termination, your access to the Service will cease. We will retain data as described in our Privacy Policy and provide data export upon request within 30 days of termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email to your account administrator and by posting notice on the Service at least 30 days before the changes take effect.

Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may terminate your account before the effective date.

13. General Provisions

These Terms constitute the entire agreement between you and Firewall Academy regarding the Service. If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right or provision shall not constitute a waiver.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
